IVA Advice

When my IVA started in June 2006 I was told by the provider that they would make payments to creditor's every year. When the first year was up I wrote to them and asked them to provide details of what payments were paid to each creditor. I received a letter back stating that they now make payments to creditor's every 2 years. Is this correct? Am I entitled to a breakdown of what payments they make to my creditor's? At the moment I pay a Standing order to my provider each month but I do not actually know where this money is going i.e. how much is going to creditor's and how much is going to them. Also when the 2 years is up in June and my provider makes a payment to my creditor's am I able to come out of my IVA and try to contact my creditor's with regards to making payments to them myself? If this is possible would I be liable for any costs to my IVA provider? The reason I ask is that with my IVA provider charging me approx £5000 in 5 years to administer the IVA would this money not be better going to my creditor's and in turn paying them off quicker? Would I be able to set up contracts with my creditors so that the amounts I agree to pay them would be in writing and all interest would not be charged and they would have to stick to this as well as me? I'm not sure but when taking out an IVA I think the IVA provider takes the whole debt into consideration i.e. including the interest and I was under the impression that when you enter into an IVA the interest should be frozen so that you are only actually paying back the money you have actually borrowed and not the interest? Many Thanks Garry

Hello Willam1974

There are no right or wrong actions in an IVA that companys can take. Each IVA Company works differently to others. You are entitled to know where your money is going and to see a breakdown of your payments; you will need to speak to your IVA provider about this. In regards to coming out of the IVA early, you are able to do this but you will have to either pay the full debt off in full or the IVA would have to fail. I wouldn’t like to say weather or not you would be liable for any IVA costs, as again each IVA providers work differently. All IVA's have fee's involved which is unfortunate but if you were to pay your debts of yourself then the creditors don’t have to freeze the interest at all, which means you may end up paying back a lot more than you originally borrowed. Hope this helps.
