Will my mum's debt affect me?

My recently divorced mother is severely depressed and is currently in the process of signing over her mortgage-free house to me for security reasons. She cannot pay off her debts since she is on long-term sickness and has no income. To support her, I am moving in with her and my 14 year-old sister, but I am afraid of creditors repossessing my personal belongings that I will be taking back into the house. I have completely separate finances from my mother and have no joint assets so, with this in mind, will bailiffs be allowed to repossess my belongings? Also, if my mother files for bankruptcy while she is living the house with me, will this effect me at all? How will her belongings be differentiated from mine? Thanks for any advice in advance! Dan

Mum's debt

Bailiffs will not be able to repossess your belongings. There is a lot of confusion over bailiffs, which is something they have taken advantage of in the past. I wanted to know what bailiffs can and can't do, I mean knowing your rights is important afterall. I found debts.org/bailiffs very helpful.

Hello tyrannos

By you moving into the property, whilst it is in your name, your mothers debt wont effect you. No bailiffs can take any of your belongings either for your mothers debt, they do ask for proof that the items to do belong to yourself though. If your mother does declare herself bankrupt, the creditors can still go after the property, because it may look to her creditors that she is hiding assets. You may want to give the CAB a call for some more advice on this. 0207 833 2182, this is the head office number, you can get further information for your local office from there Hope this helps
