I am a freeholder with a threat of eviction looming. A cowboy builder ruined renovation works in my property he also threatened me with violence(witnessed) the contract came to an end and the matter went to court. Several errors by the court and my mental health impairment meant I failed to attend court hearings and in my absence a judgement was granted to the cowboy builder to place a charge on my house. Several years later after a chance meeting of this cowboy, I get letters from a solicitor stating the judgement will be enforced. I went to court to try and sort this out in Feb of this year but, because I have been ill mentally and physically I havent been capable of managing my affairs. I placed my home on the property market in February 2008 hoping to get a sale and then make an offer to the cowboy, I put this in writing to the cowboy's solicitors. But, two weeks ago I was visited by a bailiff who advised I am to be evicted on 15.05.08. I was declared bankrupt on 05.06.07 through the same reasons I was incapable of managing my affairs. I would like to know what I can do as I would like to appeal the decsion to put a charge on my house even if I have to go as far as the high courts. The evidence I have is enough to prove my case, I cant understand why I have not been able to present my evidence in court. I feel the cowboy has no right to be able to get away with blue murder and do the same to some other victim. I understand from a family member that he has done this before and got away with it. HELP!!!
