Cash gifts and Bankruptcy

Hi I was wondering if you can help. Im in a pickle which isnt my fault. My Father in law has not paid his liabilities to HRMC spanning several years . . .. They have now investigated him and asked him to make a disclosure .. they were inviestigating under criminal proceedings but have reduced this to civil investigation of fraud and COP 9.. it looks like he is going to owe millions !!!! problem is he has made cash gifts to his son (my husband) during these years by way of supporting him as he wasnt working and giving us money to buy a house when we got married. He made this gifts and supported his son whilst not paying hrmc and wasnt done prior to stopping payments to them. He also put another house in his son's name 12years ago, when his son was in college (dont know why) . . .im worried because he will not be able to pay this debt to HRMC . . . and is refusing to make them an offer and wants to let them take him to court as he has been told both these houses are safe as they were made a while ago. Whats the likely hood of them forcing him to become bankrupt and what would happen to our house?? We aquired the house in September 2004 and since moving in I have paid all bills from employed earnings except for the council tax, house insurance and shopping which totals £330 per month, THis was paid by my husband following cash gifts from his father. We also have a son who is a year old. Many thanks Soraya‹ View

hello skang

You will have to speak to a legal advisor in regards to your query, due to the nature of your situation I am unable to give any advice as we only advise on debts. The C.A.B or a bankruptcy clerk will be able to help you and give you the help and support you need. Sorry I cannot be any more help.
