What to do?

Hello.... Having looked at all the options for solving my debt problens, it seems 'bankruptcy' is the best route for me! Can I ask, a couple of points.... 1. If only one of my debtors has made me (so far) insolvent, does that mean I can apply for Bankruptcy and include all the others that have just been writing initial threat letters to me or even ones that I am just in deep debt with? 2. I know the steps for bankruptcy, but what is the first initial one as far as applying to the Court e.g which forms and where can I obtain etc... 3. I am at a P.O. box address and my debtors/debt agencies cannot trace me. Does this mean I could hold off bankrupcy proceeding or would it be advisable to start now as i cannot pay the debts for sure? Do the Debt agencies have some sort of criteria/timescale for chasing debt? I would be applying for BCY in Scotland. Some help would be great. Thx Dave

Hello davegoingbankrupt

I will answer your questions in the order you have asked them. A1. Once you declare yourself bankrupt, all of your debts are included. You cannot go bankrupt with just one of your debts. A2. You will need to collect a petition form and statement of affairs form; you will be able to collect these from the county court. You can get help with filling these in from your local CAB. A3. Your creditors can still trace you even though you are living at a P.O box address, if you are looking at definitely going bankrupt you might as well start the proceedings now. Debt agencies can trace the debt for as long as they want, if you ignore the debt they will apply interest and charge on top so you will end up owing more than you originally did. Applying for bankruptcy in Scotland will make no difference. If you want to avoid bankruptcy then give us a call, and we will look through your details with you and try to find a more affordable and least drastic solution for you. Hope this Helps and speak to you soon.
