Is Bankruptcy the best answer for me?

I currently have approx £12,000 credit card/overdraft debt, and £2,000 in rent arrears. I don't own a house, or car, the only thing I have on contract is my mobile phone. I am just able to meet my monthly minimum payments and that can be a struggle. I am in a job that I don't enjoy, and want to retrain, but I can't currently do that as I can't save any money to put towards course fees. I feel like I am stuck in a rut and bankruptcy seems like the best viable option. If I was to go bankrupt, do I have to pay any payments afterwards? (not including the £495 bankruptcy fee). Am I legally required to inform my employers? Does having been declared bankrupt affect immigrating abroad? Many Thanks, Mark

Bankruptcy is an option that anyone can take if they owe over £750 to one creditor. But there are other options available to avoid bankruptcy, which you should always consider first. You would only pay in a bankruptcy after the fee if you could afford too, this is dependant on the court you go to and it is also up to the official receiver you would be appointed too. In regards to your employers knowing about you being bankrupt. They would more than likely found out from your Official Receiver, so it would be worth your while to make sure your employment is not effected by bankruptcy. Bankruptcy can sometimes affect you emigrating abroad. If bankruptcy is something you are considering, speak with your local court, but I would give us a call as well so we can have a look to see what is the best way forward for you to go.
