bankruptcy

My husband and I are considering bankruptcy. We owe about £8000 in total which doesn't seem like much, but my husband has been out of work with a back injury for over 6 months and we only found out 3 months ago that they sent his P45 to the wrong address, I'm out of work looking after my 18 month old baby with severe depression, although I feel ready to go back to work part time, (Job interveiw next weeK). We'd been living purely off what assistance we get for our daughter with my inlaws, and if not for thier charity after we we asked to leave our rented property for not being able to keep up with the rent, we'd most likely not have a roof over our heads. I have an outstanding debt for £867. and they are threatening action, plus a few more, mostly in hubby's name. Is thier much more these creditors can do to us? We don't have any valuble posessions, we sold what little we had when we moved to pay some bills. I don't know weather this would happen or not but if the affore mentioned company were to pertition my bankruptcy, they'd be doing me a favour. All we both want is to provide for our daughter and give her a good chance in life.

Hi I know it looks bad but bankruptcy is not the answer particularly with such a small amount of debt. Contact someone like the Consumer Credit Counselling Service (CCCS) -and they can set up a repayment plan with your creditors. Once this has been done you can inform your creditors that they are now handling your debts - the companies will listen. Sure some may want to pursue you for a county court judgement (CCJ) against you but most wont. You may only have a small amount to contribute towards any payment plan at the moment but your circumstances will improve (believe me they will) and you can then start paying more back.

Have you looked at other avenues

Bankruptcy should be the last resort when it comes to paying off debts. But by all means, everyone owing over £700.00 can declare themselfs bankrupt! The creditors can keep on persuing the money owed a number of ways. The most drastic being bankruptcy.
