Transferring of debt overseas

I have debt incurred in the UK a few years ago. I moved to South Africa and was making payments, but my contract ended and I was unable to continue. I got married and have a child and am working again, but earn only the equivalent of just over 300 pounds a month. My debt is about 16000 pounds and has now been transferred to a company in SA. By the time they have added interest and with the current exchange rate, the amount they are asking is huge. Even if I pay them every cent of what I earn until the end of my contract, it wont be enough. I live in a very rural area where the chances of getting another job are slim to none, and even if I did, the cost of transport would be so high as to negate the point in doing so. From nosing on the interenet the company that has now contacted me claims to only charge commission on successful collections, so is it possible that the debt has not been "sold", and is still owed to the original creditor? Can I clear this now by declaring myself bankrupt in the UK, or does it now have to be dealt with by SA law? Many thanks

Transferring Debt to an individual

I've been talking to a gentlemen in Alabama who says that for $2,500, he will arrange for all of your debt to be transferred to him. In other words, all your debt comes off of your record and goes on to his. He then fights the creditors in court and gets it forgiven. While this sounds like a scam, to me, I'm wondering if anyone, here, has ever heard of such a thing. Kevin Mastaw

The best thing for you to do is to call a debt advice center in South Africa and discuss this matter with them. If the debt is now in South Africa then you can make arrangements with them to pay the debt back, but because of the different laws from the UK and South Africa, unfortunately I’m unable to go into details. You are able to declare yourself bankrupt in the UK, but there may be implications to this whilst living in South Africa. Hope this helps.

Thanks. Who do I owe the debt to? Is it still HSBC, or the company that is now hassling me? I see from their website they only charge commission on what is collected. Thanks

It will properly be the company that are now hassling you for the debt. You can call the HSBC though, as they will be able to tell you if they have sold the debt on to this debt collector.
