In april of 2006 I bought a car on credit. On 21st of may that same year the car was invoved in an accident and was decalared a total loss. The insurance paid out in full as i was not at fault and the differnce was settled by the gap insurance i had taken out. Today (almost 2 years later) i have recieved a letter from a debt collection agency claiming i owe the original finance company almost £5000. I called to say this must be a mistake and was told it was not and if i do not pay in ful they would be seeking to reposses my house (something i thought would be impossible as the original finance was not secured on the house at all) I do not have much of the corrispondance from the acident in 2006, yet i do have a letter dated 18th october 2006 from the gap insurance company stating they made the final payment the the finance company. I also have a letter from the finance company dated 6th of June 2006 saying i was a valued customer and they would be willing to set up finance for me again if i wished to buy a new car. I have since bought another car again on finance with a different company and no mention was made of outstanding finace, also i have recently applied for a mortgage as we may be moving house and no mention of any outstanding money was made on my credit report. Finaly, until today i have not had any letters or corrispondence of any kind from the finance company regarding any money owing. I was promissed a call back today by the debt collection agency but they did not call. Any advice you could give would be great, as both my wife and i are very worreid about this. Regards

After reading and understanding your situation your in at the moment, my advice would be to go to your local Citizens Advice for legal advice. Because you have a letter actually stating the car and amount due was paid off in full by the insurance company, you shouldn't have to pay anything back. If you havent spoken to the debt collection agency already, then call them up and explain to them what has happened, photocopy the letter you have stating the balance was paid in full and send it to them by recorded delivery. (Keep the original for your self and take it with you to the citizens advice) I hope the above is helpful for the both of you, unfortunately cannot give any more advice than that as it is a legal issue Kind Regards
