Debt Management Plan & being taken to court

My partner and I have been with a financial Debt Management company for going on 10 years, and suddenly out of the blue, two of the creditors we owe money to have decided to take us to court. We have never failed to pay our agreed sum of money to them for almost 10 years, and our creditors always bank the money whether or not they agree to to our terms or not. The worrying thing is, is that they are now taking us to court to get more money out of us. They know how much my partner earns, (I dont work, Im a full time mom), but they still persue it with the courts to get more. I guess what Im trying to ask, is whether or not the court can disagree to the amounts we have been paying our creditors, and demand a totally unrealistic amount which would be out of our reach financially, or whether the court would see that we have been paying our debts for all these years and agree to the amount we have always paid them. Would they legally have a right to come into my home and take my possessions away even though we pay them a certain amount every month without fail. How likely is this to happen? Im worrying myself sick over this, as Im so afraid that one day someone will come to my home and take everything that we have ever worked for. Can they do this? Hope that this post makes sense because Im still trying to make sense of it all myself and failing :( Thanks in advance

Hello

If you are currently paying all that you can afford in the DMP then it is quite likely that a court would rule that you continue the payments. You should be sent a form from the courts to fill in, which is to show your income and expenditure details. Fill the form in and send it back to the court they will then get a true understanding of your situation and make a fair judgement.
The court would only allow a bailiff to come round if you can pay your debts but aren't paying.
Hope that this information helps.

Thank you. Your information

Thank you. Your information has put my mind at rest a little. Thing that I dont understand, is why now.....I mean we have paid the same amount for 10 years, and suddenly out the blue everyone seems to be taking me to court.

Hello

There could be a number of reasons why they are going to court, they may believe that they would be able to get more from you by applying to the courts. As it has been 10 Years there is a possibility that you have experienced a change in circumstances, even if it is only a small amount this could be what your creditors are looking for. As I said in the previous post, if you are paying all that you can afford then you shouldn't worry too much.
Hope this helps.
